Construction projects are inherently complex business ventures involving several interrelated parties who are engaged in unique and intricate endeavors. As a result, disputes between the parties are inevitable. Through this presentation, we hope to show how contracts can serve as a wall, to outline the boundaries of the respective parties’ obligations in the event of a dispute, to decrease claims or, at a minimum, reduce the economic burden of resolving a claim. This presentation will highlight issues that are often encountered throughout the life of a project, and propose best practices for how to plan for these issues in the contract. It will also include methods for contractors and subcontractors to protect their rights to ensure payment and/or performance when a project goes south.
