Under the OBBBA, eligible employees may deduct up to $12,500 of the “premium” portion of mandatory FLSA overtime pay (or $25,000 for joint filers) each year. The deduction applies only to the “half” component of time and a half overtime pay required under the Fair Labor Standards Act and phases out for higher income taxpayers.
