Labor & Employment Services

For over 50 years, Woods & Aitken’s representation of its clients has included the full range of labor and employment matters of concern to employers including: employment discrimination; employment contracts; non-competition and trade secret agreements; employment torts; wage/hour regulations; Family and Medical Leave Act issues; Americans with Disabilities Act issues; Occupational Safety and Health Act ("OSHA") issues; employee benefits; and union/management issues regarding union organizing, contract negotiation and contract administration.

  • Members of the Firm have a history of service on bar association committees related to labor and employment law, and have lectured extensively on labor and employment law issues.
  • One member of the Firm has served on the Executive Committee and as Chair of the Labor Relations and Employment Law section of the Nebraska State Bar Association, and served for eight years as a director of Nebraska Continuing Legal Education, Inc.
  • Members of the Firm provide assistance to employers in all facets of labor and employment law, such as:
    • General planning concerns, including contract drafting and policy and handbook development
    • Counseling management on a course of action in specific, difficult employment situations
    • Counseling and representation of management in administrative claims, such as discrimination charges, wage/hour audits and OSHA inspections
    • Representation of management in civil litigation, such as lawsuits regarding covenants not to compete, trade secret litigation, employment contract disputes and lawsuits alleging discrimination
    • Counseling and representation of management in union organizing efforts
    • Contract negotiation and administration including grievance resolution and representation in arbitrations.
  • The Firm has represented clients in labor and employment law disputes in Nebraska, Iowa, Kansas, Colorado, Missouri, Minnesota, Texas, California, Oregon, and Washington.

Our experience in these matters has enabled us to develop case management plans to assist clients in planning for the timing and costs to be incurred in litigation, and permits clients to make informed decisions about the manner in which they wish a particular matter to be approached.
